O Senado articula uma proposta alternativa de anistia para os envolvidos nos atos de 8 de janeiro. O projeto, conduzido pelo senador Davi Alcolumbre (União Brasil-AP), prevê redução de pena para réus enquadrados no crime de multidão e, ao mesmo tempo, penas mais severas para líderes de movimentos golpistas.
Pelo texto em discussão, seria criada uma qualificadora para o crime de atentar contra as instituições quando o objetivo for a tentativa de golpe de Estado. Nesses casos, a pena poderia ser aumentada de 1/6 a 1/3. A mesma regra valeria para lideranças políticas ou organizadores, ampliando o rigor da punição. Em contrapartida, a pena dos participantes de menor relevância poderia ser reduzida em até 50%.
Segundo interlocutores, a proposta não afeta a situação do ex-presidente Jair Bolsonaro (PL), já que a lei penal só retroage para beneficiar réus. A estratégia de Alcolumbre busca construir um projeto que não seja o “liberou geral” discutido na Câmara, onde há movimentos para que a anistia atinja até a inelegibilidade do ex-presidente.
